Alton Maltings Hire Agreement Terms & Conditions.
Alton Maltings can be hired by any individual, charity, business, or organisation that meets the Terms & Conditions set out below.
Before hiring the venue, it is important that you read this Hire Agreement Terms & Conditions carefully.
This Hire Agreement is a contract between:
- An organisation, individual or company responsible for hiring the venue and paying for the event.
- From here on in may also be referred to as the ‘client’ or 'hirer' or ‘you’ or ‘your’; and
1.0 Definitions. The following definitions apply:-
1.1.2 ‘Client’ refers to the individual, company, or organisation with whom AM have an agreement to provide facilities, catering or services based upon an AM quotation and any additional requirements or services subsequently requested and agreed upon.
1.1.3 ‘Organiser’ refers to the client or a designated third party employed by the client to organise the event on their behalf.
1.1.4 ‘Venue’ refers to a room (or space) or combination of rooms (or spaces) designated by AM for external hire.
1.1.5 ‘Event’ refers to the function or use for which the venue is hired. AM facilities are hired out on the basis of agreed hire rates and the Hire Agreement Terms & Conditions of booking and venue hire described below.
1.1.6 ‘Purpose’ refers to the main reason/purpose/cause behind the event being held which should not conflict or contend with, or be opposed to, the principles and values of Harvest Church. It relates to a specific booking or series of bookings, detailed as set out in the Quotation document. and includes the Hire Agreement Terms & Conditions, together with any other terms expressly agreed between the parties and clearly set out in writing.
Hire Agreement Terms and Conditions.
This Hire Agreement forms part of the Hire Agreement Terms and Conditions together with any other terms agreed between the parties and clearly set out in writing. They may not be varied without agreement with AM management.
All references to days means calendar days unless otherwise specified.
- Booking.
- Once the quotation document and the Hire Agreement Terms and conditions have been reviewed and accepted by the Hirer, we will consider the booking as confirmed.
- If any details of your event change then we reserve the right to issue a revised quotation for your agreement.
- Be as realistic as possible when advising delegate numbers. We understand that numbers can change and request that notification of changes be made to AM management by email or phone at least 14 days prior to the event.
- AM reserves the right to levy fees for cancellations, reductions or increment in numbers, which will be calculated based on the total value of the confirmed booking.
- Timing and Pricing Structure: Normal opening hours for the hire of AM are 08:30–22:00 Monday – Saturday. Closed on Sunday.
- Full day – Normal day rate. 81/2 hours between 8:30 am – 5:00 pm; 1:30 pm – 10.00 pm.
- Half day – Normal half-day rate. 4 hours between 8:30 am – 12.30 pm; 1.00 pm – 5:00 pm; 6.00 pm – 10.00 pm.
- Late Evening Rate 10:00 pm - 11.00 pm 1.5 x the hire rate.
- Extension Rate 11.00 pm onwards 2 x the hire rate.
Minimum hire period: 4 hours including setting up / setting down and leaving AM.
- Should your booking span 2 hire periods, AM reserves the right to charge for a full day.
- Special arrangements and charges will be required for any hires outside of our normal operating times, as access to the rooms requires appropriate reception and fire evacuation cover. Should you need to arrive between 07:00 – 08:00 or leave after 22:00, please contact AM management to discuss your requirements.
- We would appreciate your event not overrunning but recognise there are occasions when this cannot be avoided. Should you realise that you need to overrun, please have a conversation with us, as it may be that we have another booking that we need to set up for.
- Please ensure that your booking includes a realistic time to set up and set down.
Pricing:
The hire charge set out in the quotation document will be considered as fixed from the date of signature of this Hire
Agreement.Terms & conditions.
Our hire charges will be reviewed annually on 30th June, in line with AM’s financial year-end.
If any details relating to the booking change, we may need to issue a new quotation and Hire Agreement.Terms &
Conditions.
- Extras.
- The following resources are also available. There will be no additional costs for these items as they will be included as part of your hire but must be booked in advance: Flipchart, Projector, television & DVD, and PA.
Chargeable extras. Technical support - should you need technical support, please call us to discuss your needs.
- If you only require assistance with a basic set-up, we will provide 30 minutes for free.
- If you need more complex support, we have someone that we can put you in touch with.
- Super fast dedicated wi-fi
- Speciality tea, cafetiere coffee and Border Biscuits.
Patio. We have a newly refurbished patio area downstairs. If you would like to use this area, please contact AM to discuss.
There may be an additional fee for this.
Deposits
- For One-Off bookings, new clients or bookings that happen just 2 or 3 times a year, Alton Maltings requires payment of a deposit to confirm your booking. This will be a minimum of £20 or 10% of the hire charge, whichever is the greater and will be confirmed at the time of enquiry.
- For regular weekly/monthly clients, no deposit is required but each year we will request that you confirm the dates you are booking ideally 3 months in advance.
Catering:
If the Hirer requires catering, then there are a few options; please discuss your requirements with AM management.
- We are able to offer refreshments, tea, coffee etc.
- Where the Hirer organises their own catering, prior permission should be sought from AM management.
- The hirer must ensure their provider follows hygiene regulations. AM cannot be held liable for any illness resulting due to food poisoning etc.
- If you need to use our commercial kitchen and/or any of our kitchen equipment please discuss this prior to confirming your booking.
- The kitchen must be cleaned thoroughly after use - if AM management deems that the kitchen has not been cleaned satisfactorily, we reserve the right to invoice the hirer for any additional cleaning required.
- Final confirmation of resources. Final timings, numbers, equipment and,beverages are to be confirmed in writing no later than 7 days prior to the event date. It is the Hirer’s responsibility to provide this information.
- Event rooms and facilities
- Delegate numbers will be taken into consideration when allocating your room.
- Occasionally, Alton Maltings may need to allocate a different room to that agreed. We reserve the right to change allocated rooms and advertised facilities at our absolute discretion and to vary our details from time to time. Where this is necessary, we will give you as much notice as possible.
Prior to your event: AM may request, where applicable, copies of the following documents or confirmation that you have
these documents in place.
- A risk assessment covering all the activities you are proposing to do.
- A copy of your Public Liability Insurance.
- By agreeing to our Hire Agreement, you are confirming you are compliant with current Safeguarding regulations.
- Ofsted certificate, where applicable.
1. Use of AM:
- The use of AM and its facilities are subject to the following and to certain standard conditions incorporated in this Hire Agreement Terms & Conditions.
Enquiries for the use of AM should be made to the AM Bookings Officer or representative in their absence.
- AM rooms and assets may be hired by any individual or organisation if the stated aims and purpose of the event does not:
- break any national or local by-laws, contradict, oppose, or hinder, directly or indirectly, the stated aims and purpose of AM and The Grain House Trust. These are:-
- The advancement and proclamation of the Christian faith; and
- The work of relieving hardship and providing education and other charitable purposes
- Contravene guidance from the Charities Commission; or
- Contravene AM policies.
- AM management reserves the right to decline any enquiry or booking even after confirmation.
- All bookings are considered provisional until the Hire Agreement Terms & Conditions are signed and returned with the appropriate deposit paid.
- AM reserves the right to confirm or deny, any externally arranged services, entertainment, or activities that you have arranged. AM will not accept liability for any resultant loss.
- AM management may view and decline any Client programme, written consent, speech, display, visual aid, video, or audio material.
- All booking requirements e.g., asset requirements and room set up must be notified to AM at the time of enquiry.
- Access to the booked room[s] will be from the time booked. If you require additional time to set up/set down before your guests arrive/leave, please include this when making your booking.
- If on the day your meeting is overrunning, please talk to AM management as there may be another client waiting to use the room after your booking. If the room is free AM will be happy to allow you to remain until your meeting is complete though there may be additional charges for anything longer than a 30-minute run-over.
- Additional requirements not not made known at the time of enquiry may incur a charge.
- We would request that the Client does not sub-let the premises to any other third party.
- The Client should not use the AM for any unlawful purpose by any unlawful means.
2. Safety Requirements:
On arrival, the person responsible on the day for the event should sign in at reception. We would request that all clients keep a register of everyone attending their event.
The Client should not endanger the life or safety of users and AM staff, in particular::-
- The Client should not by their actions and/or behaviour invalidate any of the AM insurance policies.
- AM is subject to statutory regulations including, without limitation, Liquor Licensing, Fire Regulations, Health, Safety and Environment. Clients, their employees, their guests and associated third parties should therefore observe these requirements as requested by AM staff.
- Obstructions should not be placed in any of the AM fire exits, gangways/aisles, corridors, stairways or exits.
- Emergency lights should not be covered, blocked, disconnected, or used to hang décor.
- Firefighting equipment should never be discharged, moved, blocked, covered, disconnected, or used to hang décor from.
- The Hirer should have a register of all the guests attending their activity in case of emergency.
- .The Client is responsible for keeping a record of the number of attendees at their event which is to be made available to AM upon request and ensuring that the maximum capacities for each room are not exceeded.
- The Client on seeing fire or smoke should report to AM staff immediately. Or if the smoke and/or has flames, break the nearest call point glass - AM staff will call the Fire Brigade and initiate and direct fire evacuation procedure.
- Performances involving danger to the performers, public or staff are not allowed at AM.
- Flammable substances are not permitted; AM is unable to store such substances.
- All Client décor, especially of a flammable nature, should be discussed with AM management at the time of booking
- The use of smoke machines, lasers, pyrotechnics, hazardous substances, explosives and firearms are not permitted in AM
- All accidents and injuries sustained at AM should be reported to and recorded by AM staff.
- P.A.T. (Portable Appliance Test) Certificates; in accordance with the Electricity at Work Regulations 1989; are required on all electrical equipment brought into the venue. Copies of these should be provided to AM management.
- Risk Assessments and where applicable Method Statements are to be supplied by Clients in advance of the event.
- The Client and their clients/guests should not behave or introduce anything that endangers the venue, their users or insurance policies
- The Client should familiarise themselves with current AM fire and emergency procedures and any relevant policies, and follow those procedures and special instructions.
3. Damage and Loss of Property:
- The Client is responsible for all allocated rooms during the hire period, in relation to any damage to the rooms or their contents as a result of the acts, omissions or defaults on the part of The Client, their guests, employees, subcontractors or representatives.
- Any such damage or loss may incur charges to cover the cost of the damage, loss or replacement.
- AM is unable to accept any liability for the loss, theft or damage to any equipment or personal belongings brought onto the property by The Client, their guests, employees, contractors or associated third parties.
- Unclaimed lost property will be held for 4 weeks, after which it will be distributed to charity.
4. Liability Insurance and licencing:
- Liability Insurance
AM has public liability insurance covering injuries arising from a defect in the premises or its assets.
So far as is permitted by law, AM excludes liability to you, your guests, employees, and third-party subcontractors as
follows:
- Any equipment brought to AM by the hirer, your guests, employees, or third-party subcontractors is brought by that person at their own risk and you will indemnify us against all liability arising in connection with the use of the equipment. We strongly recommend that you take out Public Liability Insurance at a minimum of £10 million, which includes damage to the venue.
- The Hirer is responsible for suitable insurance cover re:-
- Personal accidents
- Third-party claim
- Loss or damage – either to an individual's property or to AM or any of its assets.
- Failure to have a public liability insurance policy could result in a claim being made against the hirer directly.
- There is no AM liability for Client negligence that results in injury.
- AM shall not be responsible for any damage or loss of personal belongings of the hirer, their guests, or subcontractors; including any damage or loss to any items stored at AM.
- If the Hirer uses an external caterer or provides catering for their event, they do so entirely at their own risk.
- The Hirer and any third-party subcontractors employed by the hirer or your guests for the purpose of organising and providing additional external events (such as teambuilding) will be required to comply with all applicable statutory requirements including relevant Health and Safety regulations and to provide liability insurance commensurate with the risks involved, appropriate method statements, risk assessments, licenses and demonstrate additional competency skills required to manage the event, in compliance with relevant Health and Safety Law. Copies of these should be provided to AM management.
- No liability is accepted for any errors or omissions in our publicity or on our website.
4. Statutory Legislation.
4.2 Alcohol Licence:
- If the client wishes to store and/or serve alcohol whether charging for it or providing it for free, please discuss with AM management prior to the event.
AM is a licensed venue under Licencing Act 2003 which covers:-
- Licensed hours are between 9.00 am – 11.00 pm Monday to Saturday. Please ensure that no alcohol is served after 10.30 pm. However, if the Hirer wishes to have Licensable activities outside of these times please discuss and obtain prior written permission from AM management.
- If the Hirer wishes to supply alcohol – both free of charge as well as chargeable. Then the Hirer will be required to sign the Authorisation for the Sale or Supply of Alcohol under the Licencing Act 2003, prior to the event.
- We would request that the client notifies AM management at the time of enquiry if their intention to make alcohol available.
- We would request that the client does not serve alcohol to persons under the age of 18.
- AM does not have a license to sell alcohol; however, a temporary event licence can be applied for from East Hampshire District Council. If you would like assistance with this, please discuss it with AM management.
- Subject to agreement over quantity and use, clients may bring in alcohol to be used at a specified event.
4.3 Late-Night Licence.
- If the hirer wishes to finish after 11.00 pm, this will require prior permission from AM management. Please note AM is unable to licence the event, so the hirer will need to arrange for a late-night licence from East Hampshire District Council and a copy provided to AM prior to the event. us.
5. Smoking Policy:
- Smoking is not allowed in any covered areas of AM.
- We would ask that the Hirer and their guests do not smoke on the bridge leading to the main entrance. There is a cigarette bin to the left of the bridge, as you leave via the main doors.
6. Betting, Gambling and Lotteries:
We would ask that your activities do not include betting, gaming and lotteries.
7. Storage:
- If you would like to store items at AM, please speak to or email AM management. AM will provide written confirmation of any decision made including how long and what items can be stored.
- AM is unable to take responsibility for storing Client items and are left at the Client's risk.
- AM reserves the right to charge for storage, this will only be done after dialogue and agreement.
8. Car Parking:
- AM is unable to be responsible for any cars parked in our car park. Cars are parked entirely at the owner’s risk.
- There is free onsite parking for 48 cars plus 2 Blue Badge parking bays. These are available on a first-come first served basis.
- AM will not be held responsible should the car park be full when the Hirer and their clients/guests arrive. If additional parking is required, please ask AM management.
- If you would like parking spaces reserved or allocated for your event, please speak to AM management who will try to accommodate your request.
- We would request that you and your clients/guests park in the designated parking bays, to ensure emergency and fire access is always maintained.
- We would request that you and your clients/guests only park in the AM car park while attending or running an event/activity unless prior agreement with AM management is sought.
- We would request that you and your clients/guests respect our one-way system operating in the car park.
- We would request that you and your clients only use the Blue Badge Parking bays if they have a legitimate reason to do so.
- In extreme cases AM may have to ask you or your clients/guests to remove your vehicle from the AM car park.
- Maltings Close, beyond our car park, is a private residential road. We would request that you and your clients/guests do not park there.
- Advice on additional parking can be provided on request to AM management.
9. Care of AM Property:
We would request that you and your clients refrain from:-
- Using Blu and white tac or similar temporary/permanent adhesive products.
- Using nails, screws, bolts, spikes, brackets, fixings, or fixtures to affix things to the fabric of AM.
- Affixing posters/signage to AM fixed signage.
- Affixing posters/signage to AM notice boards without prior discussion with AM management.
- Moving AM furniture assets without prior discussion with AM management.
- Erecting any structure without prior discussion with AM management.
- We would request that the hirer removes all items including decorations and furniture on the day of hire. If this is not possible please discuss it with AM management prior to the event.
- Any items left at AM without prior approval from AM management may become the property of AM.
- We would request that the hirer arranges to remove empty bottles at the end of the event. If the Hirer is unable to do this, please have a discussion with AM management prior to the event.
- We would request that you and your clients do not use AM ladders, or other AM products without prior permission from AM management..
10. Code of conduct:
Our desire is that AM is available and accessible to everyone, and to be as safe and secure an environment as we can
make it. For this reason, AM operates under an equal opportunities code of conduct and code of behaviour as set out
below:-
- All people and property are treated with dignity and respect.
- We would request that the hirer and their clients/guests refrain from using offensive language, or loud or unruly behaviour.
- We would request that the hirer and their clients/guests refrain from using jokes that are sexist, racist, or homophobic, any offenders may be asked to leave AM.
- We would request that the hirer and their clients/guests refrain from harassing or abusing AM staff or other users of the building. Any offenders may be reported to the police.
- AM management/staff reserves the right to terminate the Hirers event and/or eject from AM any clients/guests of the Client whose behaviour or activities are deemed to be unacceptable.
11. Amendments/Cancellations by AM:
Should AM for any reason need to make amendments to the hirer's booking, AM reserves the right to offer an
alternative room.
If a booking:-
- In the opinion of AM management, prejudice the reputation of AM or The Grain House Trust, (GHT) or contradict, oppose or hinder, directly or indirectly, the stated aims and purpose of AM and GHT as set out in section 1 of these Hire Agreement Terms & Conditions.
- The hirer is more than 30 days in arrears of previous payments to AM.
- AM becomes aware of any alteration in the hirer's financial situation.
Then AM Management will enter into dialogue with the hirer. It may result in the client's booking being cancelled.
11.1 Cancellation by the hirer:
If the hirer cancels a confirmed booking AM reserves the right to charge:-
- 25% cancellation fee if cancelled within 28 days.
- 50% cancellation fee if cancelled within 7 days.
- 100% cancellation fee if cancelled within 48 hours.
11.2 Right to Cease:
In extreme extenuating circumstances, AM retains the right to end an event: -
- If it transpires that the event has been mis-described.
- Where intentional deception has been involved in disguising the main purpose of the event to secure a booking at the premises.
- Where the purpose of the event was not made clear at the time of booking but becomes clear during the event and it is in direct conflict with the principles and values of AM.
- Where the event has overrun its agreed booking time and presents a conflict with a further booking or will require additional costs to keep the building open or the venue serviced.
- Where the continuation of the event will jeopardise the safety and security of staff, delegates, property, or the reputation of AM staff.
12. Invoicing and payment:
- Unless otherwise stated by AM management the invoice will be raised on the date of the event and forwarded to the hirer for payment. Payment is required within 30-days from the date of invoice.
- All rates are quoted exclusive of VAT (unless stated otherwise).
- Any challenge or objection to any part of the invoice should be made in writing within 5-working days of receipt of the invoice otherwise the invoice should be paid in full.
- Any event booked within 7-days of the event date should be paid for in full no later than 48 hours prior to the event for confirmation.
12.1 Late Payment Charges:
For outstanding invoices, beyond 60-days, AM management will enter dialogue with the Hirer to establish whether
there is an issue e.g., non receipt of invoice and will work with the client to resolve non-payment as quickly as possible.
- If the non-payment continues beyond 90-days, then AM management will again enter into a discussion with the Hirer and will advise them there will be a 4% late payment charge.
- If the Hirer wishes any of these charges to be settled on their behalf by a third party the hirer should contact AM management in writing 14 days in advance. Any acceptance by AM of such proposals is without prejudice to AM's rights to hold the Hirer responsible for the full amount of the invoice and/or cancellation/non-arrival charges.
- 13. Termination:
In the event that the hirer becomes bankrupt, ceases to trade, has a receiver appointed or makes any voluntary
arrangement with their creditors, AM shall be entitled to immediately terminate this Hire Agreement by giving notice in
writing to the Client or their representative(s).
14. Connection to AV/PA Equipment:
- AM provides the capability to connect projectors and electronic equipment via HDMI and VGA for visuals, and XLR or mini jack for audio (HDMI does not require a separate lead for audio).
15. Entertainment:
15.1 Performing Rights Licencing:
- Use of Copyrighted Music during events. the hirer is covered by a PRS & PPL licence held by Harvest Church for the premises. This enables clients to play recorded material from CDs, files, or streaming services at public events.
- If a hirer is holding a live concert at the premises, please discuss with AM management at the time of the booking enquiry.
- Use of films and videos during events. Should the hirer wish to show films at AM, a licence will need to be obtained from either FilmBank or MPLC (Motion Picture Licensing Corporation).
- Use of YouTube clips. The YouTube terms and conditions state that the service is for private and personal use only; therefore, clips from YouTube should not be played publicly without permission from either YouTube or the individual or company that created the original content.
- Use of Audio/Video Recording. A Limited Manufacturing Licence from PRS is required for music that, as copyrighted material, is embedded into Video or Audio recordings. Recordings of the spoken word and presentations do not require a licence.
- Use of Song words. Church or religious events, not organised by Harvest Church, that require the display, copying or reproducing of song words, will need to apply for an events licence from CCLI. 1 Jan 2018 (Version 9.0).
- Copyright Issues & Infringements. Harvest Church is unable to accept liability for any copyright issues or infringements that arise out of a hirer's misuse of copyrighted material.
16. Photography:
- If the hirer wishes to record images on any device while on AM property, please discuss in advance of the event with AM management.
- If any image is taken that clearly shows the AM logo, an employee of AM, or connects the image to AM, please seek prior approval of AM management before it is made public or is used in any promotional or journalistic publications, including all forms of social media.
- We would request that no image[s] are taken of other hirers or businesses using AM without written permission of both AM management and the client concerned.
17. Safety, Fire and Food Hygiene:
17.1 Safety & Fire.
- All events are subject to compliance with current Health & Safety and Fire Safety Regulations and to the requirements of any other relevant authorities.
- The fire alarm will be tested between 8:00 am & 9:00 am each Monday – any alarm going off at any other time the building will have to be evacuated,
- please follow the instructions of AM management.
- please request your guests start evacuating quickly; without running; and safely.
- the onsite hirer responsible person to take their hirer register and to make their way to the assembly point.
- the assembly point is at the far end of our car park.
- Once at the assembly please await further instructions.
17.2 Risk Assessments:
We would kindly request that all hirers carry out in advance of their event a risk assessment for their event and
forward a copy AM management at least 30 days prior to the event for review.
We would kindly request that hirer provide AM management advance notice of any aspects of the event which may
necessitate special safety or security arrangements. The organiser will be responsible for all consequential costs.
17.3 First Aid:
- It would be appreciated that where the hirer has more than 100 people in attendance that they also arrange adequate First Aid personnel for their event.
- If the hirer has a 3rd party first aider at their event it is requested that they inform AM management, of the following details at the start of their event:-
- Name of the trained / qualified first aider on duty during the event.
- Mobile telephone number of the trained / qualified first aider.
- the whereabouts of the trained / qualified first aider.
17.4 Portable Appliance Testing (PAT):
- If the hirer needs to use their own electrical appliances, they should ensure that they have been tested in accordance with current electrical safety legislation; damage or injury caused by faulty appliances or equipment will be the sole responsibility of the client.
- Should a hirer’s electrical equipment be found not to have been PAT tested and certified, reasonable costs associated with the tripping of electrical MCBs may be raised against the hirer together with any associated cost incurred by other clients using AM as a consequence of non-compliance with the paragraph above.
17.5 Safeguarding:
For the purpose of Safeguarding, definitions are as follows:-
‘Children’ are young people up to the age of 11.
‘Youths’ are those between 12 and 18 years of age.
‘Adults’ are those who are aged 18 years and over, who have care or support needs and are unable to protect
themselves from either risk of, or experience of, abuse or neglect.
- The hirer should recognise that AM is open to other users during the time of their event, and they will be required to plan for associated safeguarding issues for the duration of their event.
- Hirers are expected to have their own Safeguarding policy relating to children and adults with care and support needs attending events and are responsible for all safeguarding issues related to their own event.
- Hirers organising events that directly or indirectly involve the attendance of children, will be asked to complete an additional declaration relating to their safeguarding policy and procedures.
18. Provision of Free Wi-Fi:
- AM offers free wireless internet service and always uses reasonable endeavours to make this service available; however, AM will not be liable if for any reason the service is not available at any time or for any period.
- This service is intended to allow the hirer to access the internet to use, amongst other things, the worldwide web, e-mail and messaging. The client undertakes that their use of the service will be within the bounds of the law. We reserve the right to terminate the client or delegate use of the service without notice if, at any time, AM become aware of any behaviour that has a negative impact on our equipment or network, or the use of our equipment or network by other clients or delegates.
- The hirer acknowledges that use of the free service is at their own risk. The service is provided on an ‘as available’ basis, and to the fullest extent permitted by law, we hereby exclude all and any warranties or conditions of any kind, whether expressed or implied, in respect of the service and any content or data obtained or downloaded from it. We do not warrant that the free service will be uninterrupted, timely, secure or error-free. We are not responsible for the security, integrity, accuracy or completeness of any information that you transmit or receive while using the free service.
19. General:
- AM reserves the right of entry to any event.
- AM reserves the right to make reasonable changes to the Terms & Conditions including the right to amend hire charges. hirers will be liable to pay the rate applicable on the quotation document and are responsible for ensuring they have an up-to-date copy of the AM Terms & Conditions and Hire Agreement. All changes will be notified in writing by AM.
- No failure or delay by AM in exercising any of our rights under this contract shall be deemed to be a waiver of that right.
- In the event of circumstances beyond our control resulting in AM being unable to provide our services, we shall have no liability in respect of any losses or damages arising directly or indirectly from such circumstances.
- Should the hirer contract with AM through an agent, the agent acts in that capacity for the Client and not AM. The Client, therefore, accepts full responsibility for payment of the account.
- This hire agreement shall be governed by the laws of England and Wales.
- Venue hire is restricted to the purpose and organisation at the time of booking and no charges of any sort may be made by the hirer for admission to AM without discussing it with AM management in advance of the event.
- AM cannot be held liable for any failure to provide or delay in providing facilities, service, food, or beverages because of events or matters occurring beyond the control of AM management.
- If the hirer wishes to use AM’s name and/or logo on its publicity, it is permitted if the client seeks AM management approval in advance. and our brand guidelines have been followed. We would require to see the publicity for approval before it is sent to print.
- The hirer is responsible for ensuring that any band, musician, or entertainer employed by them complies with all statutory requirements of AM.
- Where applicable, VAT will be charged at the prevailing rate at the time of invoice. VAT on this Hire Agreement is calculated based on VAT at the prevailing rate at the time of booking.
